In her two-and-a-half-page complaint, Sheppard alleged that her termination by Evans was in violation of the Age Discrimination in Employment Act (鈥淎DEA鈥) and constituted a 鈥渨rongful discharge鈥 under Oregon law. In an ADEA case, circumstantial evidence can be used to establish a claim of age discrimination, if the plaintiff can establish 鈥渁 prima facie case of age discrimination.鈥 Under Oregon law, an employee can bring 鈥渁 claim for wrongful discharge 鈥榳hen the discharge is for exercising a job-related right that reflects an important public policy鈥欌 such as an 鈥渆mployee requesting leave under the Oregon Family Leave Act.鈥 Sheppard alleged that she was fired 鈥渋mmediately after she scheduled the surgery for which she requested Family Medical Leave.鈥 The district court dismissed Sheppard鈥檚 complaint 鈥渇or failure to state a claim under Federal Rule of Civil Procedure 8(a)(2).鈥 Sheppard then submitted an amended complaint, but it was dismissed for the same reason. Sheppard appealed. The Ninth Circuit reasoned that Sheppard had a 鈥溾榩lausible claim鈥 [of] age discrimination based on circumstantial evidence,鈥 because Sheppard鈥檚 complaint satisfied the requirements for a prima facie case of age discrimination. The Court determined that Sheppard鈥檚 allegation of being fired after requesting Family Medical Leave was sufficient to establish a claim for 鈥渨rongful discharge鈥 under Oregon law. Thus, the Court held that Sheppard鈥檚 amended complaint satisfied Federal Civil Procedure Rule 8(a)(2)鈥檚 pleading standard. REVERSED and REMANDED.
